Terms of engagement

These are the standard terms under which Core Nova Pty Ltd, trading as Cyber Node, delivers cybersecurity services to Australian clients. Specific engagements may be governed by a separate written agreement or statement of work, which takes precedence where it differs from these terms.

1. Scope of services

Cyber Node will deliver the services described in the agreed statement of work. Services outside the agreed scope will be quoted separately. Cyber Node will use reasonable skill and care consistent with industry standards for cybersecurity consulting.

2. Authorisation

Penetration testing and security assessment activities will not commence until the client has provided written authorisation identifying the in-scope assets, the authorised testing window, and the nominated technical contact. The client warrants that it has the legal right to authorise testing against the in-scope assets.

3. Fees and payment

Fees are fixed at the time of the statement of work and invoiced on the schedule set out in the engagement. Invoices are payable within 14 days unless otherwise agreed in writing.

4. Confidentiality

Cyber Node treats all client information as confidential. Reports, findings, and supporting evidence are shared only with the client and parties nominated by the client in writing.

5. Limitation of liability

To the extent permitted by law, Cyber Node’s total liability under any engagement is limited to the fees paid for that engagement. Cyber Node is not liable for indirect or consequential loss. Nothing in these terms excludes liability for gross negligence or wilful misconduct.

6. Intellectual property

On payment in full, the client owns the report and findings deliverables prepared specifically for the engagement. Cyber Node retains ownership of pre-existing methodologies, tools, and templates.

7. Governing law

These terms are governed by the laws of Western Australia. Disputes arising from the engagement will be resolved in the courts of Western Australia.
